Disputes & Litigation

Are you struggling with a business dispute?

Let’s face it – business is about getting on with business.

No-one likes a dispute because they can be an expensive distraction. Despite all the best intentions and being reasonable and willing to negotiate, disputes happen and cannot be avoided.

At Millens we will not take you into a speculative litigation where, before you know it, the legal costs are the main thing everyone is fighting about. We follow a “No Surprises” approach to legal costs in disputes. As soon as possible, we will give you a detailed estimate of the likely legal costs involved and we’ll explain the risks of litigation. Armed with this knowledge you can then make rational business decisions.

Our aim is to build a long-term relationship with our clients. Sometimes the best commercial decision is to walk away from a weak claim. Or, we will recommend that you settle on terms you don’t like, but can live with, because of the risks and uncertainties of going to Court. We will do this with your best interests in mind.

But when the legal fight begins we are resolved to bring your claim as professionally and as efficiently as possible. Often we are in disputes where others seem to be more focused on filling in forms and getting the process right, whereas we have a strategic approach. We may seek an early mediation or other attempts at settlement, or look for an early quick victory to make your opponent more willing to resolve the issues involved. Sometimes it’s a waiting game, to outlast the opposition and break down their resolve. We will fearlessly involve you in our strategic thinking based on our experience. Then together, we will agree upon the best way to get you the best possible commercially available and realistic result.

Millens can:

  • Negotiate early out-of-court settlements

  • Prosecute and defend commercial disputes

  • Prosecute and defend competition law disputes

  • Negotiate settlements with your employees relating to termination, discrimination or harassment disputes

Frequently asked questions

  • Experience shows us that there are very few “black and white” situations in life and the same goes for legal cases going to Court. Often we hear from new clients who have been assured by others that they have a strong winning case only to be told later that they need to settle on unfavourable terms because something changed. We never “over promise and under deliver.” We will give you a genuine assessment of your case. Telling you what you need to hear, not what you want to hear. Only then can you make a rational decision about whether the case is worth running and how much to spend. This will help you determine your risk / reward ratio.

  • In every dispute we carefully listen to you and learn about the issues and the people involved in the dispute. Sometimes there are other factors which we need to understand and discuss with you. Then, working with you, we develop a strategy to maximise the probability of a successful outcome. Sometimes signaling an early desire to settle is a clever idea, but other times it may just encourage the other side to think your case is weak and that you are willing to take an unreasonably low offer to settle. Every situation is unique and has to be separately assessed to work out the best way to proceed. Our experience and knowledge of the law will guide you and give you the best chance of a commercial result. At the same time, you’ll be informed of, and understand, the cost.
