Everyone sort of says, "Well, I know I need a will." And most people get round to doing it, but estate planning is much more than just having a will. Let's face it, the will only works when you're dead. What happens if you have a stroke or you lose capacity? So you also need a power of attorney. And the power of attorney can be for financial or it could also be for personal. But, of course, if you want the same attorney, you might as well just have one document.
And then what about medical treatment? That has to be a different document as well. And what about your superannuation? Have you got a binding death nomination under your self-managed super fund or your industry fund? Have you told the trustee of your super fund how you want your benefits paid out? And then, of course, what if you own a company and you've got control of shares? They have to be dealt with in your will. Or if you've got a trust, who's going to take over the role of the appointor of trust? And maybe there's special provisions in your trustee.
So estate planning requires us to check your trusts, look at your self-managed super fund, and look at all these documents so that you've got a coordinated package.
